Earlier this year, Governor Tom Corbett signed into law Act 13, which repealed Pennsylvania’s existing Oil and Gas Act and replaced it with a codified statutory framework regulating oil and gas operations in the Commonwealth. Soon after Act 13’s enactment, a collection of municipalities, environmental groups and others filed constitutional challenges to certain provisions of Act 13, and the case proceeded before the Pennsylvania Commonwealth Court.
On July 26, 2012, in Robinson Twp,. et al. v. Commonwealth, No. 284 M.D. 2012 (Pa. Commw. Ct. June 26 2012), the Commonwealth Court issued an opinion on those challenges. (more…)
On July 25, 2012, in EXCO Resources (PA), LLC v. New Forestry, LLC, the United States District Court for the Middle District of Pennsylvania held that an oil and gas lessee did not have an implied right to use the leasehold property for activities related to the injection of waste water from its regional drilling operations. A coalition of more than 27 building and construction industry associations announced the formation of the American High-Performance Buildings Coalition (AHPBC) to “promote and support the development of sustainable building standards, which are based on consensus and scientific performance data.”

Widely circulated recent news reports have chronicled the rise of the solar industries of China (with a huge projected increase in sales for 2012 over 2011) and Japan (a lesser but still significant increase). A further interesting development is Saudi Arabia’s determination to create a domestic solar industry for that sun drenched country. Where do the creators – the US and Europe – of solar technology stand in all of this? Massive sales drops and bankruptcy. (more…)
